These Terms of Use and AI Disclosure apply to both of the Skandhas AI companion products described below. Except where a section distinguishes between them, all terms apply equally to both.

1. What These Services Are

Skandhas offers two distinct AI-powered, voice-based companion products, both grounded in the coaching and coaching supervision work of Miguel Noguerol, ICF Master Certified Coach (MCC).

The Skandhas Insight to Action Coaching Companion is a between-session coaching tool designed to support professional and leadership development. It is grounded in the Skandhas coaching methodology and approach. It is intended to complement, not replace, your professional coaching relationship with a qualified coach.

The Skandhas Reflective Practice Companion is a reflective practice tool for credentialed coaches to reflect on their own coaching practice. It is grounded in the Skandhas coaching supervision model. It is intended to complement, not replace, your work with a qualified human coaching supervisor and mentor coach.

2. What These Services Are Not

Neither Skandhas companion is:

  • Therapy, counseling, or mental health treatment

  • Medical, legal, or financial advice

  • A licensed professional service of any kind

The Skandhas Insight to Action Coaching Companion is not a substitute for working with a qualified human coach, therapist, or advisor.

The Skandhas Reflective Practice Companion is not coaching supervision or mentor coaching. Time spent with it does not count toward any credential, renewal, continuing coach education, mentor coaching hours, or coaching supervision hours. It is not an assessment, examination, or leveling instrument, and it does not evaluate, score, or certify your competence or credential readiness. It is not a substitute for working with a qualified human coaching supervisor or mentor coach.

If you are experiencing a mental health crisis, please contact your local emergency services or a crisis helpline in your country immediately. Examples include the 988 Suicide and Crisis Lifeline in the United States (call or text 988), Línea 024 in Spain (call 024), and CVV in Brazil (call 188). In other countries, please contact your local emergency number or national crisis helpline.

3. AI Disclosure

These services are powered by artificial intelligence. Specifically:

  • Conversations are conducted through ElevenLabs' Conversational AI platform, which uses Claude, an AI language model developed by Anthropic (anthropic.com), together with ElevenLabs' voice and speech recognition technology

  • You are interacting with an AI system, not a human coach, supervisor, or mentor coach

  • AI responses are probabilistic and may vary. They are not guaranteed to be accurate, complete, or appropriate for your specific situation

  • Miguel Noguerol, MCC does not review individual sessions in real time, and does not review session content afterward except where you choose to voluntarily share it, as described in Section 8

By using either service you acknowledge that you are interacting with an AI system and understand its limitations.

4. Your Responsibility

You are solely responsible for:

  • Any decisions, actions, or choices you make as a result of using these services

  • Verifying any information or insights generated during your sessions before acting on them

  • Determining whether these services are appropriate for your specific situation

  • Your own physical, mental, and emotional wellbeing during and after sessions

  • Maintaining the confidentiality of any third party. If you are a coach using the Reflective Practice Companion, you are responsible for not sharing information that identifies your own clients or their organizations, and for meeting your own professional confidentiality obligations

Skandhas Center of Leadership and Coaching for Change, LLC and Miguel Noguerol, MCC accept no liability for decisions made in reliance on AI-generated conversations.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Skandhas Center of Leadership and Coaching for Change, LLC and Miguel Noguerol, MCC shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of these services, including but not limited to decisions made based on AI-generated content.

Your use of these services is entirely at your own risk.

6. Eligibility

By using either service you confirm that:

  • You are at least 18 years of age

  • You have the legal capacity to enter into a binding agreement

  • Your use of the service does not violate any applicable laws or regulations in your jurisdiction

7. Subscription and Billing

Free trial and paid subscription terms are managed through Squarespace and Stripe. Subscription fees are billed as described at the time of signup. You may cancel your subscription at any time through your account settings. Skandhas Center of Leadership and Coaching for Change, LLC does not offer refunds for partial billing periods.

8. Privacy and Data

Voice and conversation processing. Your conversations are processed through ElevenLabs' Conversational AI platform under Zero Retention Mode. This means the content of your conversation, including transcript and audio, is not logged or stored by ElevenLabs or by Skandhas Center of Leadership and Coaching for Change, LLC after your session ends. Each session begins fresh, with no memory of previous sessions.

Saving or printing your own session (optional, where available). If and where this feature is offered, you may choose to save or print a transcript of your own session to your own device. If you use it, a transcript of that specific session is briefly and automatically processed, for no more than a few minutes, solely to deliver a copy to your own device. This only happens if you actively choose to use this feature. Skandhas Center of Leadership and Coaching for Change, LLC does not retain, log, or review this data; it is never written to a database, and any transient copy is automatically and permanently deleted within minutes, whether or not you complete the save. Any transcript you save or print is your own copy on your own device, and you are responsible for storing it appropriately and consistent with your own confidentiality obligations, including any obligations you owe to your coaching clients.

Account and billing information. Your email address and account information are managed by Squarespace. Please review Squarespace's Privacy Policy at squarespace.com/privacy for details.

Skandhas Center of Leadership and Coaching for Change, LLC does not sell or share your personal information with third parties.

Roles of the parties. For data protection purposes, Skandhas Center of Leadership and Coaching for Change, LLC acts as the data controller for your relationship with these services. ElevenLabs acts as a data processor that processes conversation data on Skandhas's behalf and on Skandhas's instructions, under the ElevenLabs Data Processing Addendum (available at elevenlabs.io/dpa), which forms part of Skandhas's agreement with ElevenLabs and includes Standard Contractual Clauses for international transfers, including transfers relevant to the EEA, the UK, Switzerland, and Brazil. Anthropic acts as a subprocessor engaged by ElevenLabs and is bound by protections substantially as protective as that Addendum; ElevenLabs' current subprocessor list is available at compliance.elevenlabs.io. You are not a party to Skandhas's agreements with those providers.

For EU and UK users: Anthropic supports GDPR compliance for API customers through Standard Contractual Clauses, and ElevenLabs likewise offers data processing agreements for its platform. Both providers may process data outside your jurisdiction; see anthropic.com/privacy and elevenlabs.io/dpa for details.

To exercise any data rights (access, deletion, portability) contact us at mnoguerol@skandhas.com and we will coordinate with the relevant processors on your behalf.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of either service after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated via email where possible.
